In this action for medical malpractice and wrongful death, Gallardo Levin Reiter & Rogers, LLP, represented the hemodialysis center where plaintiff-decedent had been receiving dialysis treatment. It was alleged that the hemodialysis center nursing staff failed to properly monitor and failed to recognize signs and symptoms of an infection which allegedly resulted in the plaintiff-decedent’s death from sepsis. On GLRR ’s motion for summary judgment, the Court dismissed all of plaintiff’s claims against the hemodialysis center. The Court found that GLRR successfully demonstrated – through the expert affirmation of a nephrologist – that the plaintiff-decedent’s clinical presentation was consistent with his underlying co-morbidities, that he did not demonstrate the cardinal signs of infection, and that his death occurred as an end stage consequence to his underlying co-morbidities.
