The plaintiff subsequently appealed the trial court’s denial of his motion to set aside the verdict as contrary to the weight of the evidence and asked for a new trial. The Second Department agreed with Gallardo Levin Reiter & Rogers‘ contention that the verdict in defendant’s favor was based on a fair interpretation of the evidence and affirmed the defense verdict preserving Gallardo Levin Reiter & Rogers‘ victory at trial.
