In an action alleging negligence, Gallardo Levin Reiter & Rogers was awarded summary judgment dismissing all claims against its client, a rehabilitation and skilled nursing facility. Plaintiff alleges that she suffered serious injuries after slipping and falling on a patch of ice in the parking lot of Gallardo Levin Reiter & Rogers‘ client’s facility. The Court agreed with Gallardo Levin Reiter & Rogers‘ arguments that its client did not create the alleged icy condition and did not have actual or constructive notice of it. Moreover, Gallardo Levin Reiter & Rogers convinced the Court that the ice accumulated the night before the alleged accident and that a reasonably sufficient time had not lapsed since the cessation of the storm for its client to take sufficient protective measures.
