In an action for medical malpractice and wrongful death, it was alleged that Gallardo Levin Reiter & Rogers‘ client, an anesthesiologist, was negligent during the performance of a colonoscopy when he allegedly failed to appreciate changes in the vital signs of the patient who sustained a perforation during the colonoscopy. The patient was discharged from the defendant endoscopy center by the defendant gastroenterologist who performed the procedure. The patient died from complications of the perforation the following day. Gallardo Levin Reiter & Rogers moved for summary judgment on behalf of our doctor. Plaintiff’s counsel acknowledged that their expert could not refute the allegations of the Gallardo Levin Reiter & Rogers expert and agreed to voluntarily discontinue the action against our client.
